FAQ
The type of debts that we can help you with will depend on what type of debt help you opt for. For example, Debt Management Plans (DMPs) only cover non-priority debts rather than priority debts.
Priority debts are those which entail severe consequences if left unpaid, and these include items such as your mortgage, council tax arrears, utility bills and Magistrate’s Court fines. When setting up a DMP for you we will ensure that your priority debts are deducted from your monthly bills first of all. The amount that is left once you have paid all your monthly bills, including subsistence, is the amount that you will have available for payment of non-priority debts.
Non-priority debts will typically include loans, credit cards, store cards and catalogue debts. It is also possible to include loans from family and friends in a Debt Management Plan.
Not all debt solutions apply solely to non-priority debts. For example, a remortgage is a priority debt as it is secured on your home. Also, an IVA provides more protection than a DMP, because a DMP is an informal arrangement and not legally binding. An IVA, on the other hand, can include other debts providing they don’t relate to: secured debt, rent, child maintenance or court fines. It is best to seek advice from one of our experienced advisors regarding the type of debts that you will be able to include in your repayment plan.
Some solutions, such as a Debt Management Plan or an Individual Voluntary Arrangement involve costs when the plan is set up. These costs are there to cover the expenses and work undertaken on your behalf. You will always be told clearly about any costs upfront. Other solutions, such as a Bankruptcy incur costs which are payable to the Court; Debt Relief Orders incur costs which are payable to the Insolvency service.
